Terms of Service

1. Acceptance of Terms

By accessing or using MythicQuill Publishing (the "Platform"), operated by MythicQuill Publishing ("we," "us," or "our"), you confirm that you are at least 13 years of age and agree to be bound by these Terms of Service ("Terms"). If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

If you do not agree to these Terms, please do not access or use the Platform.

2. Description of Service

MythicQuill Publishing is a digital publishing platform that enables authors to publish, sell, and distribute digital books and related content (ebooks, PDFs, audiobooks, and print-on-demand physical books). Readers may purchase, download, and read content made available by authors on the Platform.

3. User Accounts

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are inactive for an extended period.

4. Purchases and Payments

All purchases are processed securely through Stripe. By completing a purchase, you authorise us to charge your selected payment method for the stated price. Prices are displayed in US dollars unless otherwise noted.

Digital products (ebooks, PDFs, audiobooks) are non-refundable once the file has been downloaded or accessed. If you experience a technical issue preventing you from accessing your purchase, please contact us within 14 days and we will work to resolve it.

Print-on-demand products may be eligible for return or replacement if the physical item arrives damaged or defective. Contact us within 7 days of delivery with photographic evidence.

5. Licences for Digital Content

Upon purchase of a digital product, we grant you a personal, non-exclusive, non-transferable, limited licence to access and read the content for your own private, non-commercial use. This licence does not include the right to:

• Copy, reproduce, or duplicate the content beyond personal backup purposes
• Distribute, sell, sublicense, or share the content with others
• Remove or alter any copyright, watermark, or attribution notices
• Use the content for commercial purposes or public performance
• Reverse-engineer or extract text for AI training datasets

6. Author Responsibilities

Authors who publish content on the Platform ("Author Users") represent and warrant that:

• They own or have obtained all necessary rights to publish the content
• The content does not infringe any third-party intellectual property rights
• The content complies with all applicable laws and does not contain illegal material
• Pricing, descriptions, and metadata are accurate and not misleading
• Content appropriate for children is clearly labelled and does not contain adult themes

We reserve the right to remove content that violates these requirements without prior notice and to withhold payment for content found to be in violation.

7. Intellectual Property

Authors retain full copyright ownership of their published works. By publishing on the Platform, authors grant us a limited, royalty-free licence to display, distribute, and process their content solely for the purpose of operating the Platform.

The Platform itself — including its design, code, branding, and non-author content — is owned by MythicQuill Publishing and protected by copyright and other intellectual property laws.

8. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Platform
• Circumvent any digital rights management or access controls
• Scrape, crawl, or harvest content or user data without permission
• Upload malware or any code designed to harm systems or users
• Impersonate any person or entity
• Engage in any activity that disrupts or interferes with the Platform

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses.

10. Limitation of Liability

To the maximum extent permitted by law, MythicQuill Publishing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Platform. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email or by displaying a notice on the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Travis County, Texas.
